Warranty Terms and
Conditions.

  1. TRAINING
    Upon purchase, CobraFlex or its authorized Dealers will provide comprehensive training on the proper operation, handling, and maintenance of the equipment (hereinafter referred to as the “Machine”). This training includes a digital user manual or user’s guide, a detailed training checklist, and documentation on the replacement of consumable parts, standard operating procedures, and preventative maintenance protocols.

CobraFlex will provide an initial training session at the time of installation or delivery, covering—but not limited to—the following areas:

Startup and shutdown procedures

Print head cleaning and maintenance

Ink and adhesive handling

Film loading, curing, and transfer procedures

Troubleshooting standard errors and software use

Proper storage and use of consumables (inks, adhesives, films)

Environmental and operational requirements (humidity, ventilation, temperature, etc.)

Customer attendance and participation in the training is mandatory. Failure to attend or complete the required training voids all warranties, support obligations, and service agreements. CobraFlex will document proof of training and retain certification records for each trained operator. It is the Customer’s sole responsibility to ensure that all operators of the Machine are properly trained and certified through CobraFlex’s program. Any damage, operational issues, or failures resulting from untrained or improperly trained personnel shall be deemed customer negligence and will not be covered under warranty.

CobraFlex will also provide instructions related to the proper operation and safe use of printer consumables, as well as best practices for the safe and responsible handling of the finished product. It is the Customer’s responsibility to:

Adhere strictly to all training, operational, and safety guidelines provided

Communicate proper handling instructions of end products to all downstream users or customers

Ensure any additional operators hired post-installation are trained and certified through CobraFlex prior to use of the equipment

Improper use or failure to follow CobraFlex’s provided training or user guidance, including but not limited to misuse of consumables, incorrect maintenance, or negligent operation, will result in the immediate voiding of any warranties, service plans, or liabilities otherwise described in this document.

See Section 4 (Liability) for further limitations and exclusions regarding improper training, operation, and damages arising from misuse or failure to follow protocol.

  1. SERVICE
    CobraFlex Printers will provide remote technical service and support for the covered equipment for a period of twelve (12) months from the installation date, with an optional (purchase price to be determined) extended warranty and service package available for an additional twelve (12) months. Extended warranty coverage must be purchased in advance before the expiration of the original term and may only be obtained through CobraFlex or an authorized dealer.

Remote support includes phone and virtual assistance only. On-site service is not included under the standard warranty and must be arranged separately. Remote service requests are handled in the order received, with an average response time for callbacks within six (6) business hours. While CobraFlex endeavors to resolve all support issues promptly, CobraFlex is not liable for any delays caused by circumstances beyond our control, including but not limited to: supply chain issues, manufacturer delays, backordered parts, shipping disruptions, natural disasters, or customer availability.

Support hours are Monday through Friday from 8:00 AM to 5:00 PM Pacific Standard Time. Emergency or after-hours service must be scheduled in advance via the CobraFlex Help Desk system and is handled on a case-by-case basis. These services are not included in the standard warranty and may be subject to additional charges.

Once the initial 12 Month service period expires, all support will be billed at CobraFlex’s prevailing standard hourly rate of $85 dollars per hour pluse travel, car rental and hotel, which may be updated at CobraFlex’s sole discretion. Customers will be informed of any changes to service rates in writing.

ON-SITE SERVICE
On-site support, including technician travel to customer facilities for diagnostic or repair purposes, is not covered under the limited warranty and will be quoted and billed separately. On-site service rates include technician time, travel time, airfare or mileage, hotel accommodations, meals, and any related expenses. All travel expenses must be prepaid in full prior to a technician’s departure. Additionally, on-site labor must be paid in full at the time of service completion. NO PAYMENT TERMS WILL BE EXTENDED. NO EXCEPTIONS.

INK & CHEMICAL POLICY

Applicability to Commercial Equipment
This policy is intended solely for equipment designated for commercial use and is expressly not applicable to consumer products. Accordingly, the warranty and service terms outlined herein shall govern only in commercial contexts and shall be interpreted in compliance with applicable state laws governing commercial warranties and service agreements.

Warranty and Service Condition
All warranty coverage, service obligations (whether remote or on-site), and technical support provided by CobraFlex are expressly contingent upon the exclusive use of consumables and chemical agents that have been explicitly approved by CobraFlex. Such approved items include, but are not limited to, inks, films, adhesives, pre-treatment solutions, and cleaning agents.

Voidance of Warranty
The use of any non-CobraFlex-approved or third-party consumables or chemical substances constitutes a material breach of CobraFlex’s warranty and service agreement terms. In the event such use is proven to be the cause of, or to have contributed to, any malfunction or damage to the equipment, all warranties, service coverage, and support obligations shall immediately and irrevocably be deemed terminated, regardless of the remaining term of the applicable warranty or service contract.

Disclaimer of Liability for Unapproved Consumables
CobraFlex disclaims any and all warranties, whether express or implied, and assumes no responsibility or liability for equipment performance, functionality, or reliability when used in conjunction with unapproved or foreign consumables. Under such circumstances, any technical assistance provided shall be considered out-of-warranty support and shall be billed at CobraFlex’s standard service rates.

No Exceptions  No exceptions shall apply.

  1. Limited Warranty – CobraFlex Printers

CobraFlex warrants to the original purchaser (“Customer”) that the CobraFlex Printer is free from defects in material and workmanship under normal use and service for a period of one (1) or two (2) years, depending on the model and purchase agreement, from the original date of purchase (the “Warranty Period”), excluding wear-and-tear items and consumable parts. This warranty is non-transferable and applies only to the Customer who purchased directly from CobraFlex or an authorized CobraFlex dealer.

During the Warranty Period, CobraFlex will, at its sole discretion, repair, substitute, or replace any part that is deemed defective and covered under this Limited Warranty. All warranty service must be coordinated and approved in writing through CobraFlex’s official support channels.

Print Head Warranty Coverage (1 printhead prorated over 12 months)

CobraFlex provides limited warranty coverage for one (1) OEM Epson print head, which is prorated over twelve (12) months from the date of installation. For example, if your printer is installed on January 1, 2022, the prorated print head coverage will end on December 31, 2022. The amount covered each month will reduce proportionally. The print head must fail due to manufacturer defect and not due to misuse, neglect, or improper maintenance.

One (1) print head replacement only is covered per printer under this policy.

The print head will be shipped via ground at no cost. Expedited shipping is the customer’s responsibility.

Customer must return the defective print head and/or covered part to CobraFlex within 30 days of receiving the replacement. Failure to do so will result in full invoicing of the current retail value of the replacement item. NOTE No additional print heads beyond the one covered head are included in this warranty. NO EXCEPTIONS.

Maintenance and Usage Requirements

Proper daily and preventative maintenance is critical. CobraFlex requires that the Wet Cap system and daily cleaning procedures be strictly followed. All maintenance logs must be retained and made available to CobraFlex upon request. Warranty coverage is void if:

The print head is found to be clogged, damaged, or inoperative due to failure to perform required daily maintenance.

Print head damage results from head strike, improper capping, or exposure to debris.

Inadequate flushing procedures are followed during extended periods of non-use.

If a printer will be idle for more than one (1) week, the system must be fully flushed, and cleaning solution must be left in the ink path. Failure to do so will be deemed neglect and will void the print head warranty and any affected components.

Exclusions – What This Warranty Does Not Cover

  1. capping Stations
  2. Dampers 
  3. Mixing motors 
  4. Recirculating pumps
  5. Boards  CobraFlex determine the failure point and will approver or disapprove
  6. Any part that touches Ink
  7. Encoder Strips or sensors 
  8. Ink Or Ink lines

This Limited Warranty does not cover any parts or components that are deemed consumable or subject to regular wear, including but not limited to:

Damage caused by improper installation, modification, misuse, abuse, neglect, power surges, or use outside of specifications.

Damage caused by improper environmental conditions (temperature, humidity, dust, ventilation) or site preparation not conforming to CobraFlex’s published guidelines.
Service or modification performed by anyone not authorized or certified by CobraFlex.
Use of non-CobraFlex inks, film, powder, cleaning solutions, or supplies, all of which void any and all warranties.

Any failures or defects resulting from third-party software, interfacing, RIP software, or computer compatibility issues, including failure to meet minimum system requirements.

Loss or damage during transit not arranged by CobraFlex.

Loss of use, business downtime, consequential damages, or profit loss due to product failure.

Customer Responsibility

It is the sole responsibility of the Customer to:

Maintain proper and regular maintenance logs.

Use only CobraFlex-approved inks, films, and supplies.

Ensure only trained and certified operators use the machine.
Prepare the site as per CobraFlex installation specifications.

Immediately report any issues to CobraFlex support for diagnosis and documentation.

Disclaimer

CobraFlex’s liability under this Limited Warranty is strictly limited to the repair or replacement of defective parts as described. In no event shall CobraFlex, its affiliates, dealers, agents, or employees be liable for any indirect, incidental, special, or consequential damages resulting from the use of the equipment, including, but not limited to, lost profits, business interruption, or downtime costs.

  1. Operator Training and Certification Requirement
    All individuals operating CobraFlex equipment must be properly trained and certified by CobraFlex or an authorized CobraFlex Dealer. It is the sole responsibility of the Customer to ensure that every operator has completed official CobraFlex training and that a valid training certification is on file with CobraFlex Printers, LLC.

Untrained or uncertified operators are strictly prohibited from operating CobraFlex equipment. Improper use by unqualified personnel may result in serious damage to critical components, including but not limited to printheads, ink delivery systems, motion control systems, and firmware/software environments.

Warranty Limitation for Untrained Use
Any damage, performance issues, or operational failure caused directly or indirectly by untrained or uncertified operators will not be covered under the CobraFlex warranty. This includes, but is not limited to:

Incorrect handling or maintenance of the printer

Use of non-standard or incompatible settings

Damage due to improper cleaning or ink fill procedures

Malfunction caused by bypassing standard operating procedures

Mandatory Documentation

To maintain warranty eligibility, the Customer must submit official proof of training and certification for each operator. Certification must be verified and acknowledged by CobraFlex prior to machine use. Failure to submit and maintain current training records may result in the immediate suspension or revocation of warranty rights.

Use of Unauthorized Trainers or Falsified Records

Use of any third-party trainer not approved by CobraFlex, or submission of falsified training records, is a direct violation of CobraFlex policy. If it is discovered that:

The training was conducted by a non-authorized party

Training documents have been altered, fabricated, or falsely represented

Operators were coached to bypass or ignore critical safety/maintenance procedures

Then CobraFlex reserves the right to immediately void the product warranty in full, refuse any further technical support, and pursue legal remedies for damages caused by breach of policy or misrepresentation.

  1. Support Staff Conduct Policy and Abuse Clause
    CobraFlex LLC is committed to providing exceptional service through a professional and highly trained support staff. We are proud of our team and stand firmly behind their right to work in a safe, respectful environment.
    CobraFlex LLC enforces a strict zero-tolerance policy regarding abusive behavior toward any employee, representative, or subcontractor. This includes, but is not limited to:

A. Use of foul or profane language

B. Verbal abuse or shouting

C. Threats (explicit, implied, or written)

D. Harassment or intimidation

E. Derogatory remarks, personal attacks, or discriminatory comments

F. Hostile or aggressive behavior through any medium (including in-person, phone, email, text, or social media)

If a customer violates this policy, they will receive a formal written warning from CobraFlex LLC. Should the abusive behavior continue following this warning CobraFlex reserves the right to immediately terminate all support services and void all warranty coverage outlined in this document. In such cases, CobraFlex may also refuse to provide future service, training, or technical assistance to the offending party.

By purchasing, using, or operating CobraFlex equipment, the customer agrees to conduct all communications with CobraFlex personnel in a respectful and professional manner. Abuse of our team will not be tolerated under any circumstances.

  1. Moving the Equipment
    If you move the equipment without prior written notice to CobraFlex LLC or its authorized dealer, your warranty will be voided immediately—no exceptions. Moving the equipment without proper authorization can cause significant internal and external damage due to vibration, environmental exposure, and improper reconnection procedures. You are required to follow CobraFlex’s approved shutdown, transport, and start-up protocols. This includes but is not limited to: securing all ink and fluid lines, powering down systems according to our guidelines, draining ink tanks and waste reservoirs if necessary, and ensuring all components are professionally re-installed. Any damage resulting from unauthorized relocation is the sole responsibility of the customer and is not covered under any portion of the CobraFlex warranty.

  2. WAIVER OF INDEMNIFICATION & CUSTOMER ACKNOWLEDGMENT
    The Customer expressly agrees to indemnify, defend, and hold harmless CobraFlex Printers LLC, its affiliates, subsidiaries, officers, employees, agents, suppliers, and authorized representatives (collectively, “CobraFlex”) from and against any and all claims, losses, damages, liabilities, costs, expenses (including reasonable attorneys’ fees), or demands arising out of or related to:

The Customer’s installation, operation, handling, maintenance, or use of CobraFlex equipment or consumables;

Any personal injury, property damage, or alleged harm to third parties or end users of products created with CobraFlex printers or supplies;

Any modifications, alterations, or misuse of the equipment or materials contrary to the instructions, training, or recommendations provided by CobraFlex;

The Customer’s failure to comply with applicable safety laws, environmental regulations, or industry best practices.

The Customer acknowledges that they have read and understood all safety, maintenance, and operational instructions provided by CobraFlex and its authorized dealers. The Customer assumes full responsibility for the proper training of personnel, safe work environments, and appropriate use of CobraFlex equipment and materials. CobraFlex makes no representations or warranties beyond those explicitly stated in the written warranty agreement.

This indemnification obligation is binding and survives the sale, installation, or use of CobraFlex products.

Customer's procurement of substitute products or services (i.e., "cost of
the cover"); or damages for loss of data, software restoration, or any
other legal theory. CobraFlex does not imply a warranty on our products for any
particular purpose; it is up to our users to fully identify and test to ensure
our products are right for you.  CobraFlex
is not responsible for the application of all products.  There are recommendations on our website.  It is the responsibility of the customer to
test products prior to selling.

  1. RETURN POLICY – FINAL SALE TERMS

Once ink has been introduced into any CobraFlex Printer—whether during customer setup, on-site dealer installation, or any form of equipment initiation—the sale is considered final and absolutely non-returnable.

NO RETURNS WILL BE ACCEPTED UNDER ANY CIRCUMSTANCES ONCE INK HAS BEEN LOADED INTO THE MACHINE.

This policy applies regardless of customer satisfaction, usage outcomes, production demands, or any claims of functionality disputes. The act of introducing ink into the machine signifies full acceptance of the equipment “as-is” and waives all rights to rescind the purchase or demand a refund.

CobraFlex Printers LLC enforces this policy without exception to protect the integrity of its equipment, ensure the authenticity of machine usage conditions, and prevent contamination or resale risks. By placing an order and completing installation, the customer acknowledges and agrees to this binding no-return policy as a condition of sale.

DO NOT INTRODUCE INK INTO THE MACHINE unless you fully accept and understand that the sale becomes irrevocable and non-refundable at that point.

6.DOA (Dead on Arrival) Policy

CobraFlex Printers provides a DOA (Dead on Arrival) coverage period of ten (10) business days from the date of installation, beginning once the customer signs off on the printer installation. During this limited DOA window, if a component is confirmed to be defective or fails under normal operation, CobraFlex will provide a replacement part and covers ground shipping only for that replacement.

After the initial 10 business day DOA period, all shipping costs for replacement parts are the responsibility of the customer as outlined in the standard warranty terms.

It is solely the customer’s responsibility to ensure that any defective part being returned to CobraFlex is properly packaged and shipped back in a secure and damage-free condition. CobraFlex is not liable for, nor will it honor warranty claims for, parts that arrive damaged due to insufficient or improper packaging during return shipping.

Failure to return the defective part within 30 days of the replacement part being sent may result in a full charge for the replacement item.

  1. LIMITATION OF LIABILITY
    Notwithstanding any other provision herein, the total cumulative liability of CobraFlex, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by the Customer for the equipment giving rise to the claim.

FORCE MAJEURE
CobraFlex shall not be liable for any delay or failure in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, pandemics, labor disputes, supply chain disruptions, or internet outages.

ARBITRATION AND GOVERNING LAW
Any dispute arising out of or related to this warranty shall be resolved exclusively by binding arbitration in [Insert State], under the rules of the American Arbitration Association. This agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.

AFFIRMATIVE CUSTOMER ACKNOWLEDGMENT
By placing an order, accepting delivery, or operating the equipment, the Customer affirms that they have read, understood, and accepted the entirety of this Warranty, including but not limited to the mandatory training requirements, the final sale condition upon ink introduction, and all limitations and exclusions of liability.

RIGHT TO MODIFY WARRANTY TERMS
CobraFlex reserves the right to update or amend the terms of this warranty at any time. Any such modifications will be communicated in writing and will apply to future transactions or support extensions.

WARRANTY REGISTRATION REQUIREMENT
Warranty coverage is contingent upon the timely registration of the product with CobraFlex within thirty (30) days of delivery. Failure to register may limit or void warranty benefits.

SURVIVAL
Sections relating to limitation of liability, indemnification, governing law, dispute resolution, and customer 

  1. Tiered Response Procedure for Customer Misconduct

  2. Purpose
    This policy establishes a structured, transparent, and equitable process for addressing customer misconduct, ensuring all actions taken are consistent, proportionate, and free from arbitrariness. The goal is to maintain professional standards and safeguard both the organization's integrity and customer relations.

  3. Scope
    This policy applies to all employees and representatives of [Organization Name] who interact with customers across all platforms, including in-person, online, telephone, and written communications.

  4. Definitions

Customer Misconduct: Any behavior that includes, but is not limited to, abusive, threatening, discriminatory, fraudulent, or otherwise unacceptable conduct as defined by the organization's Code of Conduct and Terms of Service.

Service Denial: Restricting or terminating a customer's access to services provided by the organization.

  1. Guiding Principles

Fairness: Treat all customers equitably and provide them an opportunity to correct their behavior.

Transparency: Ensure that the procedures and consequences are clearly communicated.

Proportionality: Sanctions must correspond to the nature and severity of the misconduct.

Tier 1: Verbal or Written Warning

Trigger: Minor misconduct or first-time offenses.

Action: Issue a verbal or written warning, referencing specific behavior and policy violated.

Documentation: Log the incident in the internal case management system.

Tier 2: Formal Notification and Monitoring

Trigger: Repeated minor offenses or a single moderate violation.

Action: Send a formal notice warning of potential future sanctions and implement account monitoring.

Documentation: Update internal records with detailed notes.

Tier 3: Temporary Suspension

Trigger: Continued misconduct or single serious infraction.

Action: Temporarily suspend services. Provide written notice outlining the misconduct, suspension duration, and steps for reinstatement.

Review: Review suspension by a supervisory manager before enforcement.

Tier 4: Permanent Termination

Trigger: Egregious misconduct or repeated Tier 3 violations.

Action: Permanently terminate services. Provide formal notice with justification, summary of previous actions, and appeal instructions.

  1. Appeals Process

Customers must be informed of their right to appeal any adverse action.

Appeals will be reviewed by a neutral committee or designated officer not involved in the initial decision.

A written decision will be provided within a reasonable timeframe.

  1. Recordkeeping

Maintain comprehensive records of all customer incidents, responses, and correspondence.

Records will be retained in accordance with [Organization Name]'s data retention policies.

  1. Training and Compliance

All employees must undergo regular training on this policy.

  1. NON-DISPARAGEMENT AND COMMUNICATIONS POLICY

Non-Disparagement

As a condition of coverage under this Limited Warranty, the Customer agrees that neither it nor its officers, agents, employees, or affiliates shall make, publish, or communicate to any person or entity, in any public forum including but not limited to social media, online review platforms, forums, or any other digital or print medium, any false, defamatory, or misleading statements—whether oral or written—concerning CobraFlex Printers LLC, its products, services, officers, directors, employees, agents, or business operations.

This clause does not prohibit the Customer from sharing factually accurate, good-faith experiences or criticisms, provided such statements do not amount to defamation, trade libel, or false light under applicable law. Statements made with actual malice, reckless disregard for the truth, or intent to harm shall be deemed a breach of this warranty.

Remedies for Breach

A breach of this provision shall constitute a material default under this Limited Warranty. Upon a determination of breach, CobraFlex reserves the right to suspend or terminate warranty services immediately. Additionally, CobraFlex may seek legal remedies available at law or in equity, including injunctive relief, actual damages, and recovery of attorneys’ fees and costs.

Governing Law and Dispute Resolution

This Warranty shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws provisions. Any disputes arising out of or in connection with this Warranty, including this Non-Disparagement Clause, shall be resolved by binding arbitration, mediation, or litigation, at CobraFlex’s sole election. Venue for any such proceedings shall be in Maricopa County, Arizona.

Supervisors are responsible for ensuring adherence and addressing any deviations.

FYI

The Magnuson-Moss Warranty Act (MMWA), codified at 15 U.S.C. § 2301 et seq., does not apply to commercial warranties. Its scope is expressly limited to written warranties on "consumer products," defined as tangible personal property normally used for personal, family, or household purposes. Consequently, warranties on products sold for commercial use or resale fall outside the purview of the Act.(Kleenoil USA, Federal Trade Commission)

The Federal Trade Commission (FTC) reinforces this limitation, stating that the Act does not cover warranties on products sold for resale or for commercial purposes. This interpretation is further supported by the FTC's regulations, which clarify that the Act applies to products typically used for personal, family, or household purposes, regardless of the buyer's intended use. While the MMWA does not govern commercial warranties, such warranties may still be subject to state laws, including the Uniform Commercial Code (UCC), which provides for express and implied warranties in commercial transactions. These state laws can offer remedies for breach of warranty in commercial contexts, independent of the MMWA's provisions.

In summary, the Magnuson-Moss Warranty Act does not apply to commercial warranties, focusing solely on consumer products intended for personal, family, or household use. Commercial warranties are instead governed by applicable state laws, such as the UCC.(eCFR)

Magnuson-Moss Warranty Act

I. INTRODUCTION

This memorandum addresses whether CobraFlex Printers LLC’s warranty provisions—specifically, its requirement that warranty coverage is conditioned upon the exclusive use of CobraFlex-approved consumables (e.g., inks, film, powder, and parts)—are legally permissible under the Magnuson-Moss Warranty Act, 15 U.S.C. § 2301 et seq. (the “Act”).

After reviewing the statute, the Federal Trade Commission's (“FTC”) interpretations, and CobraFlex’s stated warranty terms, it is our considered opinion that CobraFlex’s policies are lawful and enforceable under prevailing federal warranty law, and that the Magnuson-Moss Warranty Act does not apply to the subject equipment.


II. LEGAL BACKGROUND: MAGNUSON-MOSS WARRANTY ACT

The Act was enacted to improve the clarity of consumer warranties and to prevent deceptive warranty practices in consumer transactions. However, its scope is limited.

A. Consumer Product Limitation

Under 15 U.S.C. § 2301(1), a “consumer product” is defined as tangible personal property “normally used for personal, family, or household purposes.” Courts and the FTC interpret this limitation strictly. Equipment marketed and used solely in commercial or industrial contexts is not covered.

The CobraFlex DTF printers are designed for professional, high-volume textile and graphics production. The product literature, training protocols, and warranty terms all confirm that the printers are intended exclusively for commercial and industrial use. Thus, these devices fall outside the statutory definition of a “consumer product,” rendering the Act inapplicable.

III. ANALYSIS OF WARRANTY LIMITATIONS ON CONSUMABLES

A. Permissibility Under General Warranty Law

Even assuming the Act applied, it does not prohibit a manufacturer from imposing conditions on warranty coverage, provided such limitations are:

  1. Clearly disclosed in writing;

  2. Reasonably related to the equipment’s performance and safety;

  3. Not misleading regarding the buyer’s statutory rights.

According to the FTC’s published guidance, a manufacturer may deny warranty coverage where the use of non-authorized components or supplies results in equipment malfunction or damage. This is particularly relevant in highly specialized systems, such as those involving proprietary printheads, thermal controls, or chemical processes.

B. CobraFlex’s Ink & Chemical Policy

CobraFlex’s terms are unambiguous. Section 4 of the warranty policy conditions warranty coverage on the exclusive use of CobraFlex-branded inks, films, powders, and related components. Section 5 further outlines that failure to adhere to certified usage protocols—including unauthorized consumables—will void all warranty obligations. These provisions are not only reasonable from a product integrity standpoint, but they also reflect a valid interest in protecting proprietary processes and minimizing customer-side operational risk.

The disclaimer of liability for unapproved materials (Section 4.D) and the prohibition on exceptions (Section 4.E) are consistent with commercial norms and legally defensible under both state and federal law.

IV. CONCLUSION

Based on current information, it is our opinion that:

  1. The Magnuson-Moss Warranty Act does not apply to CobraFlex’s commercial-grade equipment;

  2. Even if it did, the company's conditional warranty exclusions are lawful;

  3. CobraFlex’s warranty policy—requiring the use of approved consumables—is valid and enforceable so long as it is disclosed and applied consistently.

V. RECOMMENDATIONS

We advise clients engaged in contractual relations with CobraFlex to:

  • Diligently follow all documented training and maintenance protocols;

  • Use only CobraFlex-approved consumables to avoid voiding coverage;

  • Retain comprehensive records of consumable purchases, maintenance logs, and operator certifications; and

  • Seek clarification in writing from CobraFlex if product compatibility is in question.

CobraFlex Printers – Post-Warranty Phone Support Costing Structure

Effective Date: May 1 2025

Scope:
This costing structure applies to all CobraFlex Printers customers seeking technical phone support after the expiration of the initial 1-year warranty period.

Phone Support Rates (Post-Warranty or Voided Warranty)

  • Hourly Rate: $85.00 per hour

  • Minimum Charge: 1 hour ($85.00 minimum per hour for phone support call, parts are separate).

  • No refunds or chargebacks any onsite will be charged in advance via Wire transfer or ACH.

  • Billing Increments: Billed in full hour increments; partial hours are rounded up to the next full hour

  • No Exceptions: The minimum charge applies to all phone support sessions, regardless of call length

  • Payment Terms: Payment is due in advance of support session unless otherwise agreed upon in writing

  • Scope of Support:

    • Troubleshooting and diagnostics

    • Guidance on operation, maintenance, or configuration

    • Remote walkthroughs and technical assistance

Use of Authorized Consumables

If your CobraFlex printer is out of warranty and you do not use CobraFlex branded, authorized consumables (including but not limited to inks, films, and powders), you will be billed for all service calls and online support requests at the posted rates. No complimentary service or remote help will be provided under any circumstance for non-authorized consumables.

How to Access Paid Support

  1. Contact CobraFlex Support: Call or email our support team to request assistance.

  2. Prepayment Required: An invoice will be issued for the minimum charge. Support will be scheduled upon payment receipt.

  3. Additional Time: If your support session exceeds the initial hour, additional hours will be invoiced and must be paid prior to continued support.

Note:
This structure is in place to ensure fair and consistent support access for all post-warranty customers. Free support is included for all customers within the original 1-year warranty period, provided CobraFlex branded consumables are used.
